New Proposed Regulations: QR Codes

Today, California’s Bureau of Cannabis Control (“BCC”) released proposed emergency regulations that would require that certain licensed cannabis businesses display their unique Quick Response Code (“QR Code”) where cannabis products are sold and carry their QR Code with them when delivering or transporting cannabis goods. According to the BCC, the motive for this proposal is to help consumers and law enforcement identify licensed operators and crack down on illegal activity, especially in light of the current vaping crisis. 

Today’s announcement begins a five working-day public notice period, after which the BCC will submit the proposed emergency regulations to the Office of Administrative Law (OAL). The five calendar-day public comment period begins once the OAL publishes the proposed regulations on their website as being “Under Review.” (Regulations made by emergency rulemaking have a much shorter public notice-and-comment period than regulations made via the regular rulemaking process.)
