California Legislature Adopts Psychedelic Decriminalization Bill

California Senate Bill 58 (SB 58), which removes criminal penalties from some activities involving certain psychedelic substances, has passed through both the state Senate and Assembly, and is now sitting on Governor Newsom’s desk.

We previously discussed SB 58 in detail here. However, the bill was amended a number of times since our earlier post. The most significant amendments removed protections for facilitated or supported use (now it is limited to personal use/harvesting/possession/transportation/related activities ), modified (specifically: decreased) the allowable amounts, and eliminated ibogaine from the list of controlled substances subject to the bill (which now includes DMT, Psilocybin, Psilocyn, and Mescaline).

Despite these changes, SB 58 still represents a major advance in terms of psychedelic policy. Governor Newsom has until October 14 to sign the bill, veto it, or allow it to go into law without his signature.
