Proposed Laboratory Testing Regulations Released

On Friday May 5, the Bureau of Medical Cannabis Regulation (a.k.a. the Bureau of Marijuana Control) released the proposed regulations for medical cannabis laboratory testing facilities in California, beginning a 45-day public comment period.

“These proposed testing laboratories regulations for medical cannabis follow the same process as those regulations announced last week,” BMCR Chief Lori Ajax said. “We continue to move full force ahead to meet our target launch date and I want to encourage people to provide public comment and feedback to help meet our goal.”

The proposed regulations set out the components of a medical cannabis testing license application, contain standard operating procedures for laboratories, and include which analyses will be required. Medical cannabis testing laboratories would test for cannabinoids, residual solvents and processing chemicals, residual pesticides, microbiological impurities, mycotoxins, water activity and moisture content, filth and foreign material, and heavy metals; they may also test for terpenes if a product’s label states the product contain =s terpenes, or at a provider’s request. ).

The proposed laboratory regulations also include post-testing procedures, quality assurance and quality control requirements, as well as employee personnel qualifications.

Public comments must be received by mail, fax, or e-mail no later than June 20, 2017 at 5:00 p.m. Send comments to:
